1) COPYRIGHT & REPRODUCTION

Copyright is retained by Kate Whis Photography at all times throughout the world. No image can be copied, scanned or reproduced in any form whatsoever without the prior consent of Kate Whis Photography. The Client may not alter or add to or manipulate a picture by any means or reproduce a picture in whole or in part as an element within, or as a montage with, another picture without Kate Whis Photograph’s written permission. Permission to reproduce a picture for personal use (not commercial) is granted to the Client by Kate Whis Photography only when digital images jpegs are purchased and paid in full by the Client to Kate Whis Photography.

2) USE OF PICTURES

Kate Whis Photography retains the right in all cases to use any pictures for the purposes of social media and website portfolio. For advertising or publication usage Kate Whis Photography will always gain written permission from the client.

3) RECEIPT OF PORTRAITS, WALL ART OR PRODUCTS

All orders are presumed to have been received in good condition unless the Client notifies Kate Whis Photography in writing of any discrepancy or error within 14 days of receipt.

4) COOLING OFF PERIOD

All portraits, pet portraits, books, albums, frames, etc. are non-refundable. Orders cannot be cancelled due to the custom nature of the products. Orders are made to the Client’s personal specification, (i.e. image number, print size, frame style, etc.), the Client does not have the right to a cooling off period. By placing an order with Kate Whis Photography you are committing to buy the ordered products.

5) RETURNS POLICY

Incorrectly supplied items and items of poor quality can be returned and will be replaced at no extra charge to the Client. Returns will not be considered for incorrectly ordered items or items ordered in error.

Guided Walks Terms And Conditions

1: We are not responsible for your equipment or belongings when you attend our days and we provide no facilities for their storage or safety. Your equipment and belongings are your responsibility at all times.

2: It is your responsibility to dress appropriately on the day with regard to weather conditions, environment and temperature. We advise that you wear clothing that is appropriate to the activities and conditions.

3: We do not tolerate any discrimination on the grounds of ethnicity or race, religious beliefs or a person’s age or sex, nor do we tolerate any abusive behavior towards other clients or staff. Anyone being abusive may be asked to leave. If you feel that you are being the subject of any abuse on the day please see the me with your concerns.

4: No refreshments are provided on the walk, please bring your own if required.

5: Toilet facilites are limited on the walks.

6: Attendees must provide their own fully operational camera equipment, we do not provide any spare gear.

Cancellations & Refunds

All of the Guided Photography Walks are to be paid for in full and in advance. Once payment has been made, you will receive a confirmation email together with full details. We are not responsible for late cancellations and we do not offer refunds on that basis.

All cancellations must be in writing.
We offer a full refund or equivalent credit for bookings cancelled or rescheduled providing we receive more than 30 days notice.
From 14 – 30 days notice cancellation a 70% refund will be given.
From 5 – 14 days notice cancellation a 50% refund will be given.
No refund or change will be offered on cancellation of 5 day or less.
No refund will be offered for non attendance.
If the Cornish weather gives us steady rain or unsafe conditions, we can reschedule for free, rescheduled date must within 28 days of the postpone date.

Changes to the guided walk

We reserve the right to make changes to the guided walk advertised. If cancellation is due to circumstances beyond our control (e.g. fire, flood, industrial disputes, bereavement, etc.) we may give less than 30 days notice. Should this unlikely event occur, we will contact you to advise you of the guided walk changes, and give you the option of accepting or rejecting the change. If you choose to reject, we will offer you a full refund of your payment for the guided walk, or you can transfer any payments already made to an alternative Kate Whis Photography guided walk.

Cancellations by Kate Whis Photography

We reserve the right to cancel any guided walk and should this happen, we will contact you as soon as is reasonably possible. Upon cancellation, we will offer you a full refund of your payment for the guided walk, or you can transfer any payments already made to an alternative Kate Whis Photography guided walk.

Personal Safety & Fitness

To take part in the guided photography walk, you must be able to walk for up to 5 hours depending on the walk chosen, on uneven surfaces, be able to climb over a stile and tackle steep and gentle hills, there will be plenty of stops for photography.

Each Customer is responsible for maintaining their safety at all times. By agreeing to take part on the tour, all Customers are agreeing to listen to the safety instructions given by the Guide and to exercise due care and attention whilst walking.

However, all outdoor activities carry some element of personal risk and you need to accept that accidents and injuries can sometimes happen. In the interest of safety you must undertake to follow the instructions or guidance of your tour leader on guided events, follow the advice, warning or advisory notices encountered during the event, follow the countryside code, and act sensibly and prudently at all times.

It is also important for the client to understand that he/she is expected to be responsible for him/herself and that he/she should not put other members of the group or general public at risk.

Responsibility for Loss

Kate Whis Photography accepts no responsibility for loss or breakages of personal belongings during any of its walks.

Parental Responsibility

If young people under 18 years of age join a day walk or walking tour, parents or guardians undertake to accept full responsibility and supervision of and for their children at all times.

Dogs

We welcome dogs on our guided photography walks, your dogs are your responsibility, dogs must be kept under control and on a leash when near to farm animals and wildlife. They must not enter premises unless the proprietor gives permission for them to do so.

Photographs

Kate Whis Photography reserves the right to use photographs taken of you by the guide during the walk on its documentation and website if the customer has agreed to this. The copyright for all such photographs belongs to Kate Whis Photography.

Testimonials

Kate Whis Photography reserves the right to use customer testimonials on its documentation and website if the customer has agreed to this.

Dog Beach Photoshoot Terms And Conditions

1: We are not responsible for your equipment or belongings when you attend our photoshoots and we provide no facilities for their storage or safety. Your equipment and belongings are your responsibility at all times.

2: It is your responsibility to dress appropriately on the photoshoot with regard to weather conditions, environment and temperature. We advise that you wear clothing that is appropriate to the activities and conditions.

4: No refreshments are provided on the photoshoot, please bring your own if required.

5: Toilet facilites are limited on the photoshoots.

6: Please ensure that if your dog has a poo it’s bagged and binned.
